Service Agreement
Welcome to Demand & Supply. These Terms and Conditions ("Terms") govern your use of our services, which include connecting customers with service providers (e.g., home cleaning, private tutor, repairs, etc.) via our platform. By accessing or using our platform, you agree to be bound by these Terms.
Definitions
- "Platform" refers to the website and mobile app operated by Demand & Supply.
- "Customer" refers to individuals or businesses who request services through the platform.
- "Service Providers" (also referred to as "Professionals") refers to individuals or companies offering services through the platform.
- "User" refers to both Customers and Service Providers collectively.
User Registration
To access our services, you must register for an account on our platform. You agree to provide accurate, complete, and updated information during the registration process. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4. Use of the Platform
You agree to use the platform for lawful purposes only and in accordance with these Terms. You shall not:
- Engage in any fraudulent, harmful, or unlawful activities on the platform.
- Post misleading or inappropriate content.
- Attempt to reverse engineer, hack, or exploit the platform.
Service Requests and Bookings
- Service Request: Customers may submit requests for services through the platform. The request will be sent to the available Service Providers in the relevant area.
- Bookings: Customers can book a service by confirming the details provided by the Service Provider, including cost and time. A booking is considered confirmed once the Customer accepts the service proposal.
- Cancellation and Rescheduling: Either party may cancel or reschedule bookings based on the platform's cancellation policy. Fees may apply for cancellations made within a specified time frame.
Payment and Fees
- Service Fees: Customers agree to pay the agreed-upon fees for the services provided by the Service Providers. Service fees may vary based on the type of service, location, and duration.
- Payment Method: Payments must be made through the platform's payment system, which may include credit/debit cards, wallets, or other payment options.
- Platform Commission: Demand & Supply may charge a commission or service fee for facilitating the transaction between the Customer and Service Provider. The commission structure will be detailed on the platform.
- Refunds: Refunds may be issued at the discretion of the platform, subject to the platform's refund policy.
Service Providers' Responsibilities
Service Providers agree to:
- Perform services in a professional manner and in accordance with the agreed-upon terms.
- Maintain all necessary licenses, certifications, and insurance, where applicable.
- Comply with all applicable local laws and regulations related to the services they provide.
- Maintain the highest level of service standards and customer satisfaction.
Customer Responsibilities
Customers agree to:
- Provide accurate information regarding the requested service.
- Ensure access to the premises or required area for the service to be provided.
- Treat Service Providers with respect and courtesy during service provision.
- Promptly make payments for services rendered.
Platform Liability and Disclaimers
- Platform's Role: Demand & Supply is not responsible for the quality or outcome of the services provided by Service Providers. The platform merely facilitates the connection between Customers and Service Providers.
- Limitation of Liability: To the fullest extent permitted by law, Demand & Supply will not be liable for any damages, losses, or claims arising out of or in connection with the services provided by Service Providers or the use of the platform.
- Indemnification: You agree to indemnify, defend, and hold harmless Demand & Supply, its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the platform or violation of these Terms.
Privacy and Data Protection
We value your privacy and handle your personal information in accordance with our Privacy Policy. By using the platform, you consent to the collection and use of your information as described in our Privacy Policy.
Termination
- Termination by User: You can deactivate your account at any time by notifying us through the platform's support section.
- Termination by Demand & Supply: We reserve the right to suspend or terminate your account if you violate any of these Terms or engage in unlawful activities.
Dispute Resolution
Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration, following the rules of [Arbitration Organization Name]. You waive your right to participate in class action litigation.
In any case claim/reimbursement would be maximum upto 25% only of last fee paid by that person.
Changes to Terms and Conditions
We may update these Terms from time to time to reflect changes in our services, platform, or legal requirements. When we update the Terms, we will notify users through email or by posting an update on the platform. Continued use of the platform constitutes acceptance of the revised Terms.
